Market launch, distribution and protection of networked products
Data is considered the oil of the 21st century. Nevertheless, our legal system does not provide for ownership of data. So, for example, you do not own the data in your own smartphone.
However, there are legal options other than ownership to legally assign data exclusively to you or your company. In order to achieve this, however, the complex interests involved must be considered at an early stage.
Example: In a ground-mounted photovoltaic system, the solar panels are automatically aligned (maximum solar alignment, protective position in the event of storms). The manufacturer of the alignment system collects weather data via sensors on site. The solar panels are controlled by the manufacturer of the alignment system via an Internet connection. A weather service would like to "buy" the data collected on site by the sensors in order to improve its own forecasts. Who is allowed to sell this data from the sensors? The manufacturer of the sensors will point out that they have produced the sensors and are allowed to take the sensor data with them, e.g. for maintenance. The supplier of the alignment system will object that the system only works because it is controlled via the Internet. The operator of the photovoltaic system will point out that he bought the system including the sensors and bears the risk of failure. So is everyone entitled to the data?
The FORUM INDUSTRY 4.0 AT GERBER will provide answers to these and related questions, such as how to deal with cases of industrial espionage, as part of a compact event. In addition, the requirements to be observed when launching networked Industry 4.0 products will be discussed in detail. Aspects of distribution will also be considered, e.g. the contractual dealer compensation claim, which is very costly for the entrepreneur. The event will end with an example using a medical smartphone app that collects data from patients and sends it to the manufacturer via a server system for further processing.
