OLG Cologne: Internet contact form without privacy policy can be warned

OLG Cologne, judgment of 11.03.2016, Ref. 6 U 121/15

An internet contact form about which no information is provided in the privacy policy is unlawful and can be warned by competitors and associations for a fee. This was decided by the Higher Regional Court of Cologne. It is also correct to consider whether consent is even required. VOELKER has already pointed out this problem in the past, which was hardly taken into account in practice, at least before the recent ruling by the Higher Regional Court of Cologne.
