Separation from the managing director

The shareholders have lost confidence in the managing director.

The reasons for this can be business failure, different ideas about the company's strategy, but often also breaches of duty by the managing director, including criminal misconduct. When separating from the managing director, a distinction must be made between two levels, namely the executive body (i.e. the office of the managing director) and the employment relationship (i.e. the employment contract with provisions on remuneration, vacation, retirement benefits, etc.). Great care must be taken when terminating both legal relationships with the managing director, and swift action must be taken when separating for good cause.
