Termination and resignation of the Managing Director
Conversely, there are cases in which a managing director wishes to terminate their collaboration with the company of their own accord. This is often due to conflicts within the group of shareholders or the desire to work for another company or become self-employed. In principle, a managing director can resign from office at any time and without any particular reason. However, he exposes himself to liability risks vis-à-vis the company if he terminates his position on the board at an inopportune time. Even the termination of his employment contract may not release a managing director from subsequent obligations, such as a non-competition clause.
