Enforcement of and defense against legacies and compulsory portion claims

The so-called compulsory portion entitlement ensures that the next of kin receive a minimum share of the deceased's estate. If, for example, a testator who has divorced and later remarried names his second wife as his sole heir, this does not mean that the children from the first marriage are left completely empty-handed. They are entitled to a compulsory portion amounting to half of their statutory inheritance share. Especially in the constellation described above, the parties involved are often unwilling to accommodate each other. The situation is similar if a bequest has been made to a third party who is not otherwise involved and the legatee only demands fulfillment from the heir(s). In order not to fall behind in this case and to help enforce your own rights, professional help should always be sought.
