If a deceased person leaves more than one heir, a community of heirs is created by law. The heirs jointly assume the rights and obligations of the deceased. They form a so-called community of joint heirs. The administration and, in particular, the settlement of the estate falling under this community of joint heirs is extremely prone to conflict. The matter is further complicated if one of the co-heirs has received advance payments during the deceased's lifetime, which are now to be settled as part of the settlement of the community of heirs. Proper administration of the community of heirs and an economically sensible settlement of the estate can generally only be achieved with professional help.
