OLG Frankfurt a. M.: Withdrawal period may be extended to one month
In this case, the online shop operator was sued - as far as can be seen from the reasons for the ruling - because it had deliberately stated the withdrawal period as "one month" instead of "fourteen days" in the withdrawal policy and thus deviated from the model withdrawal policy set out in the law. The OLG Frankfurt a. M. has now ruled that the amended withdrawal policy complies with the law and is not objectionable. The online shop operator had offered an extended right of withdrawal, which the consumer had accepted. The decision is also important from another perspective: The Higher Regional Court of Frankfurt am Main ruled that the information provided by the online shop operator becomes part of the contract due to the new legal situation that has been in force since June 2014. This also applies, for example, to delivery times (e.g. "2 to 3 days"), which are included in the product information.
